Terms of use

Eligibility. You must be at least 18 years old to register, claim a track or sell a track on Selecta Trax.

The deal. Every track on Selecta Trax is sold exactly once. When your claim is settled and delivered, you receive the agreed package (masters, pre-masters, stems, MIDI where listed) with full, exclusive, transferable rights to release the work under your own name. The plaque remains displayed as CLAIMED.

Claims. Placing a claim reserves the tracks and is confirmed personally before payment. Until settlement we may release the reservation if we can't reach you within 72 hours.

Digital content & your right of withdrawal. Under EU consumer law you normally have 14 days to withdraw from an online purchase. Because every track is digital content delivered immediately once your claim is settled, you are asked to expressly consent to immediate delivery and to acknowledge that this waives your 14-day right of withdrawal, in line with Article 16(m) of EU Directive 2011/83/EU — you confirm this explicitly with a checkbox before every claim. Outside of this waiver, nothing here limits any consumer right that cannot lawfully be waived in your country of residence.

Previews. Member previews are for evaluation only. Recording, ripping, sampling or redistributing previews is prohibited and ends the membership.

Producers. By submitting you warrant the work is 100% yours, original, unreleased and unshared; that samples are royalty-free, licensed (with proof) or original; and that vocals are transferable. You agree to indemnify, defend and hold harmless Selecta Trax and any buyer against claims, losses, damages and costs (including reasonable legal fees) arising from a breach of these warranties — including a third party alleging that a track you submitted infringes their copyright or other rights. Violations may lead to refunds, removal and account suspension. Producers receive 70% of the sale price, plus 50% of the project-file price when sold; payouts within 48 hours of request. Exclusivity applies while listed; removal can be requested after 4 months.

Copyright claims & buyer protection. Selecta Trax relies on the producer's warranty above and does not independently verify ownership of every submission. If a track turns out to infringe a third party's rights, we remove it, offer the affected buyer a refund or an equivalent replacement, and may withhold or claw back the responsible producer's payout to cover that cost — pursuing the producer directly for anything beyond it, per the indemnity above. Selecta Trax's own liability in this situation is limited to cases where we had actual knowledge of the infringement or acted with gross negligence; see Copyright & DMCA policy for how to report a claim.

Fair play. No scraping, no bulk automation against the site, no attempts to bypass the member gate.

Liability.The site and its catalog are provided “as is”. To the extent permitted by law, Selecta Trax is not liable for indirect or consequential losses arising from use of the site or a claimed track. Nothing here excludes liability that cannot lawfully be excluded or limited under applicable consumer protection law.

Governing law. These terms are governed by the laws of Spain, under Spanish and EU law. If you are a consumer resident elsewhere in the EU, you also keep the protection of any mandatory consumer-protection rules of your own country of residence.
